I provide legal advisory for the Clients both as part of ongoing legal services within the Law Firm and referrals to the Clients as an in-house lawyer.
Witold Masionek has over 8 years of experience in legal advisory related to matters regarding broadly understood intellectual property law and new technologies law – industrial property law, copyright law, personal data protection, telecommunications law and media law.
In terms of the services provided by Witold to the Clients, he creates, reviews and negotiates commercial contracts, conducts due diligence processes and supports Clients in transactions related to the transfer of intellectual property rights and technology transfers.
Witold conducts audits regarding proper implementation and further compliance of the processes related to the processing of personal data – also by handling the role of the Data Protection Officer.
Witold supports Clients during regulatory bodies inspections proceedings and court proceedings, in all matters related to the proceeding – including but not limited to setting a strategy for the proceeding, creation of the action plan, setting legal steps to ensure the defense of the Clients rights.
Witold also has practical experience in drafting and negotiations of the implementation and maintenance agreements, as well as in the protection of the confidential information, trade secrets and know-how, commercialization of intellectual property assets and technology assets.
In the field of the trademarks protection, Witold supports Clients in the procedure of application of the trademarks, oppositions or invalidation proceeding, protection of the trademarks in terms of prosecuting and combating counterfeit trademark goods.
Witold’s experience includes cooperation with Clients from the following sectors: automotive – dealers, brokers of rental/leasing agreements, car fleet management companies and rent a car companies, publishers and developers of games, pesticides, pharmacy, social media, broadcasting, creative/ media, clothing industry, construction companies, luxury goods and alcohol manufacturers.
He graduated from Warsaw University – Faculty of Law and Administration. District Bar Council in Warsaw – Advocate.
